GENERAL

Please carefully read the following Terms and Conditions. They will form part of your Service Agreement and/or any other signed agreement in written form or your electronic acceptance of our offer such as email (hereafter collectively referred to as “the Service Agreement”) with FindinGreece, a Sole Proprietorship with National Tourism Organisation registration number (MHTE) 1174E60001010801. Furthermore you must not send any booking form including the contact e-form and/or sign and/or accept any Service Agreement with FindinGreece unless you fully understand and agree with these Terms and Conditions. Your rights under your Service Agreement will be determined by the type of Services and/or Suppliers’ Products you book including but not limited to a walking tour, fishing trip, scuba diving and snorkelling.
These Terms and Conditions, as may be amended from time to time, apply to all our Services directly or Suppliers’ Products (through Supplier) made available in our office (Aegiali, Langada, 84008 Amorgos, Cyclades, Greece) or online, through any mobile device, by email or Catalogues or by telephone. By accessing, browsing and using our website www.findingreece.com or any of our applications and/or by completing a booking form, you acknowledge you have read, understood and agree to the Terms and Conditions set out below.
Please review these Terms and Conditions periodically for changes. If you object to any provision of these Terms and Conditions or any subsequent modifications to these Terms and Conditions or become dissatisfied with this Website in any way, your only recourse is to immediately terminate use of this Website. Furthermore we also recommend for additional details about privacy of all the Clients and visitors of the Website www.findingreece.com that you read our Privacy Statement.
If you require additional information, please do not hesitate to contact us and speak to one of our helpful Team Members.
These pages, the content and infrastructure of these pages including the Catalogues, the “Contact us” e-form, the booking forms, brief description of our Services and Blog and/or any other information provided on these pages and through the Website are owned, operated and provided by FindinGreece and are for your personal, non-commercial use only, subject to the Terms and Conditions set out below.

KEY-POINTS

  • Reservations of Services and/or Suppliers’ Products are subject to availability.
  • Reservations can be made by persons of 18 years and above. For children under 18 years of age, reservations must be made by an accompanying adult, providing his/her written consent to the participation in the Service and/or Suppliers’ Products or activity.
  • A Client, by making a reservation of our Services and/or Suppliers’ Products on behalf of himself/herself and all those members of his/her party or family who accompany him/her represents that he/she has the authority to accept these conditions on behalf of and binding upon all those members of his/her party or family who accompany him/her during our Services and/or Suppliers’ Products.
  • It is the Client’s responsibility to keep and provide valid documentation when required (ID, passport, Visa where applicable etc).
  • In case of any comment or complaint, please make sure you address us or our Team Members directly at the time of the incident so that we make sure we find an adequate solution. Otherwise, we accept complaints in written form (in our office or via email) the latest 7 days after the provision of the Service under question for which we will try to do our best to resolve the issue.

It is also important to note that in case of multiple Services and/or Suppliers’ Products booked with us for a period extending more than one day (hereafter collectively referred to as “the time period”), we expect comments or feedbacks or complaints to be done during the time period of service provision. Any claim or complaint that is submitted after the time period may be rejected and the claimant shall forfeit its right to any (damage or cost) compensation.
Furthermore we also recommend that you read our disclaimer below for cases where FindinGreece is not held responsible.

DEFINITIONS

“Catalogues” mean all the hardcopy or electronic brochures and/or leaflets and/or newsletter and/or any written correspondence including emails and/or link from our Website or a search engine or a third-party website that promote or advertise or describe or feature our Services and/or Suppliers’ Products.
Client”, “you”, “I”, “me” or “myself” means yourself and/or your spouse and/or your child / children and/or minor(s) that is/are under the age of 18 and you have the parental / guardian rights and responsibility of them, and will accompany you during our Services and/or Suppliers’ Products, who will make a reservation of our Services and/or Suppliers’ Products on behalf of yourself and all those members of your party or family who will accompany you and represent that you have the authority to accept these conditions on behalf of and binding upon all those members of your party or family who will accompany you during our Services and/or Suppliers’ Products.
FindinGreece“, “Company”, “us“, “we”, “me”, “I”, “my” or “our” means FindinGreece, a Sole Proprietorship titled “Semeli Drymoniti”, with the distinctive title “FindinGreece” and National Tourism Organisation registration number (MHTE) 1174E60001010801, incorporated under the laws of the Hellenic Republic and having its registered address in Langada, Aegali, Amorgos 84008, Greece, and its Partners.
“Reservation of Services”, “reservation form”, “booking form” or “reservation” means all the types of written request and/or correspondence by the Client, including the contact form, direct electronic messages, mobile phone text messages, Messenger, WhatsApp, Viber or other social media platform messages, which are sent in order to request or to proceed with the reservation and/or the booking of our Services and/or Suppliers’ Products.
Service” means all services or products or events or activities made available through our Website or our Catalogues.
Suppliers” mean, including but not limited to, the partners, providers of attractions, museums, sightseeing tours and activities and/or network of companies (including any of their employees, directors, officers, agents, representatives or affiliated companies), government agencies and individuals who can assist in the running of our Services and/or Suppliers’ Products.
Please note that further to FindinGreece Service Agreement terms, you might also need to agree and comply with the Supplier’s terms and conditions.
Suppliers’ Products” mean the products and/or services owned, controlled or made available by the Suppliers either directly (e.g. owners) or as agents and/or through us as associates in our office, on the Website or our Catalogues. The Suppliers are responsible for the Suppliers’ Products. FindinGreece does not own or directly control any of the Suppliers’ Products that you can find in our office or through our Website and/or Catalogues, including but not limited to boat tours, packages, or visit to local farms.
“Team Members” mean all members of staff and officers of FindinGreece, guides, tour escorts, servant, associates or agents of the Company.
Website” means the website: www.findingreece.com and/or all the websites and applications and/or platforms including social media platforms on which the Service is made available or promoted or advertised or described or featured, owned, controlled, managed, maintained and/or hosted by FindinGreece.

SCOPE OF OUR SERVICE

Through the office and Website, we (FindinGreece) promote our Services and/or suggest Suppliers’ products and services and/or other activities, through which visitors of the office and/or the Website can make such reservations including but not limited to private cruises, island tours. By making a reservation through our office or FindinGreece Website, you enter into a direct (legally binding) contractual relationship with us, with which you make a reservation for our Services and/or Suppliers’ Products (as applicable). From the point at which you make your reservation, we may transmit the details of your reservation to the relevant Supplier(s).
Before you make a reservation of our Service, please note that the information that we disclose on our Website or Catalogues is based on the information provided to us by Suppliers. Although we will use reasonable skill and care in performing our Service, we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our Website or otherwise), inaccurate, misleading or untrue information or non-delivery of information.
Furthermore FindinGreece is in no way responsible for the accuracy, timeliness or completeness of Services, since FindinGreece has no control over the Suppliers’ Products standards and quality but can only verify the content uploaded through our personal and our Team Members experiences. It is not possible for us to guarantee the standards, the quality of Suppliers Products and/or our Services including activities displayed in our office, our Website or Catalogues. Suppliers’ Products and/or Services may be cancelled or change constantly and additional charges (e.g. service charges, local taxes and fees) may apply, so you should always check whether the price asked for a reservation is the one you expected.
Our Service is made available for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, or photos or products or services available in our office, our Website or Catalogues for any commercial or competitive activity or purpose.

PRICES

We believe that the prices on our Website and Catalogues are highly competitive. All Services prices are per person and all prices are displayed including VAT/sales tax and all other taxes (subject to change of such taxes), unless stated differently on our Website and/or Catalogue.
Our prices are based on financial data as of January 2023 and are valid for the current year (2023). In the event of an unexpected increase in VAT applicable immediately, or any similar increase in costs involved in our Services, FindinGreece reserves the right to revise the prices of Services provided. Revised prices will be applicable for reservations made from the time of their publication and beyond. For Services reserved prior to the publication of the revised prices, the prices valid at the time of reservation apply.

DATA PROTECTION

It may be necessary to ask you for details of a personal nature such as dietary requirements, physical / medical disabilities etc. It may be passed to Suppliers who at our discretion need to know such details in advance. We may also use your details to pass to other divisions in our Company whom we may feel would be of interest to yourself.
By no means will this information be used for third party marketing purposes. All information is kept strictly confidential. For more information please see our Privacy Statement.

PAYMENTS

A reservation is not considered secured until deposit has been made. The amount of the deposit depends on the Service required but in any case should correspond to a minimum of 30% of the total amount of the reservation. Where a Service Agreement has been signed or a confirmation of the electronic acceptance is sent, the deposit amount, payment and cancellation policy are stated in that document.
Balance of the reservation must be paid 30 days prior to the date of the Service provision, except for reservations that are made during the last 30 days, in which cases the whole amount is expected to be deposited upon reservation.
Please see below in our Cancellation Policy section, the clause related to non-payment of balance 30 days prior to the date of Service, as expected.
Individual activities, with duration of one day or less, are prepaid in full upon reservation.
The vouchers issued for our Services are personal and not transferrable to others. In case of change on the voucher data, a fee of 15 € is expected.

CANCELLATION

By making a reservation with FindinGreece, you accept and agree to the relevant cancellation policy, and to any additional terms and conditions of FindinGreece that may apply to you, including for services and/or products offered by the Suppliers.
Please note that certain rates or special offers are not eligible for cancellation or change. Applicable city/tourist tax may still be charged by FindinGreece and/or the Supplier in the event of a no-show or charged cancellation.
We reserve the right to cancel or modify reservations where it appears that a Client has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error.
Furthermore cancellation and prepayment policies may vary according to Service type.
Late payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds are of your own risk and account and you shall not be entitled to any refund of any (non-refundable) prepaid amount unless FindinGreece agrees or allows otherwise under its (pre)payment and cancellation policy.
If you wish to review, adjust or cancel your reservation, please revert to the confirmation email / voucher and follow the instructions therein. Please note that you may be charged for your cancellation in accordance with the General Cancellation Terms.

General Cancellation Terms:

  • For cancellations made up to 30 days prior to the date of Service, no fee will be charged (except for transaction fees and/or applicable city/tourist tax).
  • For cancellations made 29-21 days prior to the date of Service, 25% of the total amount of the reservation will be charged (except for transaction fees and/or applicable city/tourist tax that are charged extra).
  • For cancellations made 20-8 days prior to the date of Service, 50% of the total amount of the reservation will be charged (except for transaction fees and/or applicable city/tourist tax that are charged extra).
  • For cancellations made during the last 7 days prior to the date of Service or in case of no-show, the total amount of the reservation will be charged.

If balance payment hasn’t been completed 30 days prior to the date of Service, as expected according to our payment policy above, the Service is cancelled and the deposit withheld. All date limits mentioned above are inclusive.
Where a Service Agreement has been signed or the electronic acceptance is sent, the cancellation policy is stated in that document.
Cancellations are considered valid in written form (email) and the date of cancellation is the date of the relevant email sent.
We recommend that you read the bellow terms carefully prior to making your reservation and if you need further assistance, please do not hesitate to contact us directly and speak to one of our helpful Team Members.

DANGERS

Company’s Services may involve risks above and beyond those encountered on a more conventional holiday. Services promote activities involving walking tours, fishing trips, scuba diving, snorkelling and other adventurous activities which inhere dangers and can result in serious injury and even death. Our Team Members and/or Suppliers can help reduce these dangers but they cannot eliminate them. You must be prepared to accept the risks associated with the above mentioned services and all other activities before you require our Services. Likewise, you must also be prepared to accept responsibility for your own actions during our Services. Although our Team Members and/or Suppliers may provide you with advice and directions, it is ultimately your responsibility to determine where your limits of capability and experience are and to avoid crossing these limits. We and/or Suppliers will not be held accountable for the choices and decisions you make during our Services and/or Suppliers’ Products.
Additionally, the Company recommends destinations in geographical regions where, among other things, the standard of accommodation, transport, safety, hygiene, cleanliness, medical facilities, telecommunications, and infrastructure may not be of the standard that you are used to or would find on a more conventional holiday. The safety of roads and standard of driving practices may also be lower in some of these destinations relative to what you are accustomed to. Although we do our utmost to ensure that our Team Members adhere to local driving laws and drive carefully and safely, we cannot guarantee your safety while driving with us and will not be held accountable for road accidents that occur during your use of our Services.
By agreeing to these Terms and Conditions you accept the risks outlined in the above two paragraphs and fully assume the risks of using Company’s Services. You agree to release the Company from any liabilities connected to these risks.

HEALTH

The Company is not responsible for any health problems arising from environmental factors and/or allergic symptoms and/or reactions including extreme physical sensitivity to particular substances or conditions during your use of our Services and/or Suppliers’ Products.
We recommend that you do the following before you travel or use our Services and/or Suppliers’ Products:
1) Read Health Advice for Travellers available from your Country Health Office.
2) Consult your doctor on current inoculations before you decide to use our Services and/or Suppliers’ Products. If you have any medical conditions that may affect your ability to enjoy and/or partake fully our Services and/or Suppliers’ Products, you must notify us immediately.
The Company reserves the right, where appropriate, to ask you to provide written certification of your medical fitness prior to the requested Service and/or Suppliers’ Products. It is your responsibility to ensure that you obtain all recommended or required inoculations, take all recommended medication and follow all medical advice before and/or during and/or after our Services and/or Suppliers’ Products.

INSURANCE POLICY

The Company is covered by a liability insurance contract, according to the laws of the Hellenic Republic regarding the operation of a travel agency.

However, please note that no travel insurance is included in FindinGreece prices or offered in our Services. However we strongly recommend that you acquire an Insurance Policy that will cover you for the duration of your stay in Greece. Please contact an insurance broker in your own country.
Furthermore we strongly recommend that this Insurance Policy covers adequate personal accident, medical, evacuation and repatriation expenses. It is strongly recommended that the policy also covers cancellation, curtailment, loss of effects and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the Client.
Therefore, you, together with your personal property including baggage, are at all times solely at your own risk. You are wholly responsible for arranging your own Insurance Policy, understanding the particulars of the policy. When purchasing Insurance Policy, you should ensure that there are no exclusion clauses limiting protection for the type of activities, such as our Services and/or Suppliers’ Products, in your trip.
The Company cannot be held responsible if you purchase an inadequate Insurance Policy or if you fail to notify the Company of factors affecting your particular requirements for cover.
The Team Members reserve the right to exclude, without refund or recompense, a Client who does not have appropriate insurance cover from those Services or Suppliers’ Products or activities or tour for which adequate insurance cover is in the opinion of the Company required.

RESPONSIBILITY

The Company will use all due care for the provision of its Services and activities provided to Clients; however, Clients participate in activities and use our Services and/or Suppliers’ Products at their own risk.
While using the Company’s Services and/or Suppliers’ Products you agree to accept the authority of the leader and/or local operator at all times. You are aware that joining a tour group such as a walking tour may involve compromise to accommodate the diverse desires and physical abilities of group members. You understand that the Company reserves the right to decline, accept, or retain any person as a member of the group at any time. You acknowledge that the Company contracts with several Suppliers including a network of companies, government agencies and individuals to assist in the running of its Services. We believe, through our personal and Team Members’ experience, that our Suppliers are qualified to perform the duties they are contracted to.
However, the Company will not be held liable for any injury including death, damage, loss, delay or irregularity that may occur due to the behaviour of these Suppliers. The Company will not accept responsibility or liability for any Client who contravenes any law or regulation of the Hellenic Republic. No Team Member of the Company has the authority to vary these conditions.
No liability or responsibility is accepted by the Company for any injury, illness, damage, loss, accident, expense, or any other claim arising from involvement in any activities or provision of any Services and/or Suppliers’ Products howsoever suffered, even in circumstances where Team Members of FindinGreece or Suppliers may have negligently breached any duty of care that they may owe or have owed in connection with such activities, conduct, supervision, or the provision of Services and/or Suppliers’ Products. The Company will no longer be liable for direct or indirect losses, arising from any such injury, illness, damage, loss accident, or expense including consequential loss or economic loss however caused.
These Terms and Conditions are governed by the laws of the Hellenic Republic.

CORRESPONDENCE AND COMMUNICATION

By completing a booking or contact form, you agree to receive an email or other written correspondence by us, including direct electronic messages, mobile phone text messages, Messenger, WhatsApp, Viber or other social media platform messages which we may send you shortly prior to our Services, giving and providing you with information on our Services. Please see our Privacy Statement for more information about how we may contact you.
In order to duly complete and secure your reservation, you need to use your correct contact information. We are not responsible or liable for (and have no obligation to verify) any wrong or misspelled email address or inaccurate or wrong (mobile) phone number or credit card number.
Furthermore FindinGreece cannot guarantee that any of your request or communication will be (duly and timely) received/read by, complied with, executed or accepted by us.

COMPLAINTS

In case of any comment or complaint, please tell our Team Members immediately and they will attempt to resolve the matter to your satisfaction. It is in everyone’s interests to sort the matter out as quickly as possible.
Any claim or complaint against FindinGreece or in respect of the Service must be promptly submitted, but in any event within seven (7) days after the provision of the Service under question in writing by email delivered to info@findingreece.com, for which we will try to do our best to resolve the issue. We will respond within thirty (30) days of receipt of your email. Any claim or complaint that is submitted after the seven (7) days following the provision of the Service may be rejected and the claimant shall forfeit its right to any (damage or cost) compensation.
It is also important to note that in case of multiple services booked with us for a period extending more than one day (hereafter collectively referred to as “the time period”), we expect comments or feedbacks or complaints to be done during the time period of service provision. Any claim or complaint that is submitted after the time period may be rejected and the claimant shall forfeit its right to any (damage or cost) compensation.
Please ensure that your voucher/email reference and/or Service Agreement reference and any photos are included. If you fail to do this, any right to compensation, which you may have, will be extinguished or reduced.

LIABILITY / DISCLAIMER

Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our Services, up to an aggregate amount of the aggregate cost of your reservation as set out in your booking form or confirmation email (whether for one event or series of connected events) and/or Service Agreement.
However and to the extent permitted by law, neither we nor any of our Team Members and Suppliers or others involved in creating, sponsoring, promoting, or otherwise making available the Company and its Services shall be liable for:

  1. any punitive, special, indirect or consequential loss or damages, or
  2. any inaccuracy relating to the information of the Suppliers’ Products and/or our Services as made available on our Website and Catalogues, or
  3. the services or the products offered by us or the Team Members or the Supplier or other business partners, or
  4. any (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our Services and/or Suppliers’ Products, or
  5. property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by us or (wholly or partly) attributable to the Supplier or any of our other business partners (including any of their employees, directors, officers, agents, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the catalogue or Website or our Services, including any (partial) cancellation, overbooking, strike, public holidays, force majeure or any other event beyond our control, or
  6. We will not be responsible for any (personal) injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:
  7. The fault of the Client(s) affected him/her or any member(s) of his/her party or family who accompany him/her during our Services and/or Suppliers’ Products, or
  8. The fault of a third party not connected with the provision of your reservation which we could not have predicted or avoided, or
  • An event of circumstance which we as the Service(s) providers or the Supplier(s) of the Supplier’s Product(s) in question could not have predicted or avoided even after taking all reasonable care, or
  1. The fault of anyone who is not carrying out work for us (generally or in particular) at the time.

A Reservation of our Services and/or Suppliers’ Product’s’ is accepted on the understanding that you appreciate the possible risks inherent in participating in activities undertaken in difficult conditions, remote locations, extreme climate conditions, with animals, insects, plants or fish, and that you undertake the tours, activities or expeditions featured in our Website and Catalogues at you own volition.
In addition, we will not be responsible where you do not enjoy our Services and/or Suppliers’ Product’s’ or suffer any problems because of a reason you did not tell us about when you reserved one of our Services and/or Suppliers’ Product’s’ or where any problems you suffer did not result from any breach of our Service Agreement or the Reservation of Services or other fault of ourselves or, where we, our Suppliers or Team Members were responsible for them, or where any losses, expenses, costs or other sum you have suffered relate to any business. Please note that we cannot accept responsibility for any services, which do not form part of our Service Agreement or the Reservation of Services. This includes, for example, any additional services or facilities, which your hotel or any other supplier agrees to provide to you where the services or facilities are not advertised in our Website or Catalogues, and we have not agreed to arrange them.
FindinGreece is liable or responsible for the remittance, collection or withholding of the relevant taxes due on our Service’s price and/or collection or withholding of the relevant taxes due on the Supplier’s Product price to the relevant tax authorities.
FindinGreece is not liable or responsible for the remittance or payment of the relevant taxes due on the Supplier’s Product price to the relevant tax authorities, the Supplier is.
We are also not responsible for services and product quality that are not included in our prices, for example the quality of meals or souvenirs purchased at the places of visit.

COPYRIGHT NOTICE

Unless stated otherwise, all content, information and material including photos and/or Client’s photos on our Website and/or Catalogues and/or blog are owned by FindinGreece, a Sole Proprietorship with National Tourism Organisation registration number (MHTE) 1174E60001010801.
FindinGreece exclusively retains ownership of all rights, title and interest in and to all content (text and presentation including infrastructure) of the Website and/or Catalogues on which the Service and/or Supplier’s Product is made available (including the Clients’ reviews and photos under our Website and translated content) and you are not entitled to copy, scrape, (hyper-/deep) link to, publish, promote, market, integrate, utilize, combine or otherwise use the content (including any translations thereof and the Clients’ reviews) or our brand without our expressly written permission.
To the extent that you would (wholly or partly) share your content (including your reviews and photos) through our Website applications and platforms including social media platforms including but not limited to Facebook, Instagram and Twitter or would otherwise own any other content and share it on our Website applications and platforms or make comments of others Clients’ reviews and photos, you hereby assign, transfer and set over all such copyrights to FindinGreece. Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our rights reserved (including copyright and database right).
Additionally, FindinGreece exclusively has the right, at its discretion, to delete and/or disallow and/or block and/or refuse to public any comment and photos to its blog or to any other applications and platforms which are controlled, managed or maintained by FindinGreece.
Furthermore please see below in our Model Releases section, the clause related to the use and reproduction by FindinGreece, or anyone authorised by FindinGreece, of any and all photographs or videos.

MODEL RELEASES

For valuable consideration, you hereby irrevocably consent to and authorise the use and reproduction by FindinGreece, or anyone authorised by FindinGreece, of any and all photographs and/or videos and/or drawings therefrom and any other reproductions or adaptations therefrom either complete or in part alone or in conjunction with any wording and/or drawings which FindinGreece or Team Members have, during Services provision or Suppliers’ Products provision, taken of you, negative or positive, proofs of which are hereto attached, for all uses and for any purpose whatsoever including publicity and/or merchandising and/or editorial purposes in any country, without further compensation to you. All negatives, together with the digital files and prints shall constitute FindinGreece property, solely and completely.

MISCELLANEOUS

To the extent permitted by law, these terms and conditions and the provision of our Services shall be governed by and construed in accordance with the Hellenic Republic law and any dispute arising out of these general terms and conditions and our Services and/or Suppliers’ Products shall exclusively be submitted to the competent courts in the Hellenic Republic.
In the event of a dispute about the content or interpretation of these terms and conditions or inconsistency or discrepancy between the English version and any other language version of these terms and conditions, the English language version or the Greek language version to the extent permitted by law shall apply, prevail and be conclusive. The English version is available on our Website (by selecting the English language) and our office or shall be sent to you upon your written request.
If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, you shall remain bound by all other provisions hereof. In such event, such invalid provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and you will at least agree to accept a similar effect as the invalid, unenforceable or non-binding provision, given the content and purpose of these terms and conditions.

BY AGREEING TO THIS RELEASE AGREEMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ CAREFULLY!
RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS AND INDEMNITY AGREEMENT (HEREAFTER THE “RELEASE AGREEMENT”)
This Release Agreement covers and forms an inseparable part of the FindinGreece Terms and
Conditions.

To: FindinGreece, a Sole Proprietorship with National Tourism Organisation registration number (MHTE) 1174E60001010801, Team Members including members of the Company, employees, tour escorts, guides, associates or agents of FindinGreece, Suppliers and its representatives, successors and assigns (all of whom are hereafter collectively referred to as “the RELEASEES”).

Assumption of Risk: I am aware that by accepting FindinGreece Services and/or Suppliers’ Products involving but not limited to walking tours, fishing trips, scuba diving, snorkelling and other adventurous activities or any other activities promoted and/or offered by FindinGreece (hereafter collectively referred to as “the Company”) involve various risks as these are described on the above pages of the Company’s Terms and Conditions document (hereafter collectively referred to as “the Company’s Terms and Conditions document”). I am aware that there is a risk of negligence by the Company and/or the Team Members, including the failure by the Company and/or the Team Members to safeguard or protect me from or warn me of the risks, dangers and hazards of the Services and/or Suppliers’ Products and other activities. I freely accept and fully assume all risks, dangers and hazards associated with participating in FindinGreece Services and/or Suppliers’ Products and the possibility of loss, personal injury or death resulting therefrom.

I hereby acknowledge that I am eighteen (18) years of age or older. I acknowledge that I have read the entire Company’s Terms and Conditions document, that I have been given the opportunity to ask questions and receive answers to my satisfaction, that I have had the opportunity to have an attorney of my choosing review the Company’s Terms and Conditions document and this Release Agreement, that I understand its terms, that by accepting it and making a Reservation of Services and/or sending my electronic acceptance and/or signing a Service Agreement with FindinGreece, I am giving up substantial legal rights I might otherwise have, including that I am accepting a complete and perpetual release and bar to any and all claims of ordinary negligence resulting from my participation in the Company’s Services and/or Suppliers’ Products; as well as I hereby agree as follows:

1) To waive any and all claims that I have or may in the future have against the RELEASEES and to release the RELEASEES from any and all liability for any loss, damage, expense or injury, including death, that I may suffer or that my next-of-kin may suffer as a result of FindinGreece Services and/or Suppliers’ Products due to any cause whatsoever, including negligence, breach of contract or breach of any statutory or other duty of care, on the part of the RELEASEES, and further including the failure on the part of the RELEASEES to safeguard or protect me from or warn me of the risks, dangers and hazards of participating in the FindinGreece Services and/or Suppliers’ Products.

2) To hold harmless and indemnify the RELEASEES from any and all liability for any property damage or personal injury to any third party resulting from my participation in FindinGreece Services and/or Suppliers’ Products;

3) This Release Agreement shall be effective and binding upon my heirs, next-of-kin, executors, administrators, assigns and representatives, in the event of my death or incapacity;

4) This Release Agreement and any rights, duties and obligations between myself and the RELEASEES to this Release Agreement shall be governed by and interpreted solely in accordance with the laws of the Hellenic Republic and no other jurisdiction; and

5) Any litigation involving myself and the RELEASEES to this Release Agreement shall be brought solely within the Hellenic Republic and shall be within the exclusive jurisdiction of the Courts of the Hellenic Republic.
